Affiliate and creator terms
Rules for partners, influencers, UGC, and paid recommendations.

These terms are issued, and the affiliate and creator program is operated, by Byte development s.r.o., company ID 21661235, Příkop 843/4, Zábrdovice, 602 00 Brno. Contact: support@tvojedata.cz.
1. Basic program rules
- The partner accepts these terms when submitting an affiliate or creator application. An individual written agreement takes precedence.
- Low-risk partner applications are activated automatically. Suspicious, consumer-like, or incomplete applications await company and fraud verification; API/Printables credentials are issued only after express eligibility approval.
- The program is intended for transparent recommendations of eSIM plans, without misleading claims, fake reviews, or unapproved paid campaigns.
2. Permitted channels and disclosures
- The partner may use its own website, newsletters, organic social media, video content, comparisons, community recommendations, approved coupons, issued QR stands, and the official TvojeData widget.
- Every paid or rewarded recommendation must be clearly identified as advertising or a commercial collaboration, for example with #ad, #sponsored, or another understandable disclosure placed with the recommendation.
- The partner must not claim to be an official network operator, an official representative of TvojeData.cz, or the holder of a non-public official discount unless approved in writing.
3. Prohibited practices
- Brand bidding: without written approval, buying search ads for TvojeData, tvojedata.cz, misspellings of the brand or domain, or other brand variants is prohibited.
- Cookie stuffing: the partner must not set an affiliate cookie without a genuine user click, through an iframe, pop-under, toolbar, redirect chain, preload, or another concealed technique.
- Fake reviews: the partner must not create fake reviews, commission them from third parties, incentivize a review without disclosure, or misrepresent customer ratings and experiences.
- Unapproved paid media: paid campaigns in Google Ads, Sklik, Meta, TikTok, native-ad networks, cashback services, or coupon aggregators require written approval before launch.
- Spam: unsolicited email, bulk direct messages, automated comments, contact scraping, misleading push notifications, and any communication without the recipient's required consent are prohibited.
- Misleading discounts: the partner must not promise an official, guaranteed, exclusive, or time-limited discount unless it can be supported by an active approved coupon.
4. Commissions, payouts, and clawbacks
- Percentage commission is calculated from the resolved order contribution margin before affiliate commission, not from the customer's total spend. That margin uses the amount actually charged, trusted provider cost from the locked pricing snapshot, and payment costs; where no usable snapshot exists, a controlled cost estimate is used. Standard rates are 20% for links and the widget, 15% for coupon codes, 25% for QR stands, and 35% for commission-mode childpanels. An individually agreed written percentage is a manually configured static override, remains in effect until changed in writing, and does not automatically step down after the first order. API resellers use a prepaid wallet and wholesale pricing, while markup childpanels receive 60% of the price markup.
- A commission-funded coupon is the exception: its full pool is calculated once from the pre-discount catalog-price contribution margin, and the full shared discount actually granted to the customer is deducted from that pool; commission is not recalculated from the already-discounted amount. `FIXED_CZK` commission and every fixed bounty are capped to the order's non-negative resolved contribution margin.
- Payout is made by bank transfer after the hold period. First or higher-risk conversions may undergo automated fraud and attribution checks before being included in a payout.
- A refund, chargeback, coupon misuse, self-referral, duplicate order, prohibited paid-media overlap, or breach of these terms triggers a clawback: commission may be rejected, deducted from a later payout, or recorded as a negative balance.
- TvojeData.cz may suspend a payout if a conversion requires fraud review, attribution review, a dispute hold, or legal assessment.
5. Suspension and termination
- TvojeData.cz may suspend a partner for breach of the terms, suspected fraud, damage to the brand, regulatory risk, or false claims about price, privacy, network availability, or refunds.
- After suspension, the partner must not use new tracking links or coupons. Previously accrued claims are assessed according to the status of the conversions and the seriousness of the breach.
6. Creator agreement and UGC usage rights
- The creator confirms that the content is their own or that they have the right to use it, that it does not infringe third-party rights, and that it includes the required disclosure of a paid collaboration.
- The creator grants TvojeData.cz a non-exclusive, royalty-free, worldwide licence to use supplied UGC, the creator's name or brand, handle, screenshots, and excerpts for reposting, landing pages, internal reporting, and paid promotion only within the scope of the approved campaign.
- Paid use of creator content in dark posts, whitelisting, Spark Ads, or similar advertising formats requires separate written approval unless expressly included in the collaboration order.
- The creator must not present a personal experience they did not have or make measurable unsupported claims, such as cheapest, guaranteed delivery within three minutes, anonymity, or universal coverage by a specific network.
7. B2B API, Printables, and resale
- API and Printables credentials provide a wholesale B2B reseller flow: the partner buys the service from Byte for its business or onward sale and is not thereby appointed as Byte's or TvojeData's agent, employee, or official representative.
- Where the partner resells the service to a consumer in its own name, the partner is responsible for its applicable pre-contract information, contract summary, consents, withdrawal rights, privacy, payments, complaints, and regulatory duties toward that customer.
- The API `acceptedTerms` field records the partner's acceptance of the B2B terms and the specific wholesale order. It is not evidence that the end customer saw or accepted any terms or summary, and the partner must not describe it as such.
- Direct TvojeData consumer checkouts separately display and hash the specific contract summary and the customer's own express consent.
